Terms and Conditions

Welcome to the Muzigal Terms & Conditions page. This document outlines the legal agreement between you and Muzigal Edutech Pvt Ltd., which operates the Muzigal Platform (the "Platform") for music education. The terms are structured into a general section for all users and specific sections for online and offline learners.

General Terms of Use


Agreement and Platform Use

By using the Muzigal Platform, you agree to these Terms of Use, the Privacy Policy, and any other applicable terms. This agreement applies whether you are a "Teacher" or a "Student." The platform is intended exclusively for the purchase, sale, and conducting of music lessons. Any other use is a violation of this agreement and may result in the refusal of access.

User Accounts and Communications
  1. Account Creation: You must register and provide accurate, complete information to use certain features. Your account is for your individual use only; you may not impersonate others or create multiple accounts.
  2. Account Responsibility: You are responsible for your password and all activity on your account. You must notify Muzigal immediately of any unauthorized use.
  3. Communications: By creating an account, you consent to receive communications from the Operator and other users. The Operator may review any messages sent through the platform's internal messaging service.
Teacher Qualifications
  1. Approval: Individuals seeking to become a "Teacher" on the platform must be approved by the Operator.
  2. Minimum Criteria: The general criteria for approval include:
    • 2+ years of music teaching experience, OR
    • 5+ years as a professional musician with music as your primary source of income.
  3. Background Check: You may be required to provide information for a background check. The Operator can reject your application at their sole discretion.

Intellectual Property and User Content


Proprietary Rights

Muzigal and its licensors own all proprietary rights in the platform and its content ("Operator Materials"), which are protected by copyright. You may not copy, modify, or sell any Operator Materials without explicit written permission.

User Content and Usage
  1. Definition: "User Content" includes any material you submit to the platform, such as during a lesson. You are responsible for the accuracy of your content.
  2. License: By submitting User Content, you grant Muzigal a perpetual, non-exclusive, worldwide license to use it for the purpose of the platform.
  3. Recording: You grant the company permission to record audio, video, and images during classes for marketing, advertising, and service improvement. All rights and ownership of this content belong to the company.
  4. Prohibited Content: The platform strictly prohibits content that is:
    • Offensive, harassing, or libelous.
    • Sexually explicit or violent, especially involving minors.
    • Promotes illegal activities or unauthorized copies of copyrighted work.
    • Used for commercial activities without prior written consent.
Recorded Lessons
  1. Ownership: The Operator owns all rights, including copyright, to any recorded lessons ("Recordings").
  2. Purpose: Recordings are for the purpose of learning music and are intended for private use within the platform by the student, parent/guardian, teacher, and Operator.
  3. External Use: You may not post audio or video from recordings to any third-party media-hosting website (e.g., YouTube, Vimeo) without permission.
  4. Minors: If a student or teacher is under 18, the consent of a parent or legal guardian must be obtained before creating a recording.

Online Learner-Specific Terms


Technical Requirements
  1. Equipment: You must have a computer and a webcam.
  2. Bandwidth: A minimum connectivity of 500 kbps (upload and download speed) is required.
Scheduling and Payment
  1. Scheduling: Lessons can be scheduled up to 24 hours in advance. A student may also schedule a lesson up until it is completed if invited by a teacher.
  2. Payment: Payment is made to Muzigal Edutech Pvt Ltd. at the time of booking. This creates a platform credit that can be used for lessons.
  3. Rescheduling: Lessons can be rescheduled with at least 24 hours' notice ("Appropriate Notice").
Cancellations and Refunds
  1. Cancellations: Cancellations should only occur in "extreme circumstances."
  2. Refunds: Refund requests are handled on a case-by-case basis and are at the sole discretion of the Operator.
    • If you are dissatisfied, you should contact [email protected] within 48 hours of the lesson to be considered for a reschedule, a different teacher, or a refund.
    • The Satisfaction Guarantee does not apply if you miss or are late to a lesson due to your own actions.
    • No refunds are generally provided if a lesson is impossible due to your inadequate hardware or bandwidth, or inappropriate conduct.
    • Refund settlement can only be processed after at least one teacher and subject change attempt has been made.
    • Refunds will not include payment gateway charges.
  3. Refund for Enrolled Students (Applies to unused lessons):
    • Under 6 years old: You may seek a refund for unused lessons. The payable amount is limited to the fee paid for services not rendered.
    • Over 6 years old: You may seek a refund for balance classes after satisfying certain criteria:
      • Within 30 days of enrollment: 70% of the balance class fee.
      • Beyond 30 days of enrollment: 50% of the balance class fee.
      • This policy applies to enrollment packages up to and over 24 classes.

Offline Academy Learner-Specific Terms


Attendance and Transfers
  1. Attendance Policy: You must provide a minimum of 24 hours' notice for any class cancellation, or the class will be forfeited.
  2. Class Credits: Class credits are non-transferable, except within immediate family members for 1-year enrollments.
  3. Inter-Academy Transfers: Transfers are available only for students in 1-year programs. A minimum of 3 months must be completed at the original academy before a transfer can be requested. A prorated fee will apply post deductions of taxes and any contingent liabilities.
  4. Minors: If a student or teacher is under 18, the consent of a parent or legal guardian must be obtained before creating a recording.
Financial and Content
  1. No-Refund Policy: All payments are non-refundable.
  2. Textbooks and Certification: Costs for textbooks and external certification are not included in tuition fees and are charged separately.
  3. Class Contigency: In case of disruption, the company may fulfill remaining classes either online or at a nearby franchise location.
Conduct and Parent Responsibility
  1. Student Conduct: Students are expected to adhere to the academy's code of conduct. Disruptive behavior may lead to disciplinary action, including suspension or dismissal without a refund.
  2. Child Safety: The academy is committed to a safe environment for all students.
  3. Parent's Responsibility: Parents are responsible for ensuring their child follows academy policies, including punctuality and attendance, and for notifying the academy of any changes in contact or medical information.

Disclaimer of Warranties and Liability


  1. The platform and all services are provided on an "as is" and "as available" basis. Muzigal makes no representations or warranties regarding their operation, accuracy, or freedom from viruses.
  2. Muzigal is not liable for any direct, indirect, or consequential damages resulting from the use of the platform.
  3. The total liability of Muzigal to you will not exceed the amount paid by you to the Operator in the 12 months prior to the action giving rise to the liability.
  4. Muzigal does not guarantee any results from using the platform and is not liable for statements made by teachers or other users.
  5. Muzigal is not responsible for any technical malfunctions or the conduct of any user, whether online or offline.

Other Important Terms


  1. Age Restriction: The platform is intended for users over 18 or minors with legal parental/guardian consent.
  2. Jurisdiction: This agreement is governed by the laws of India, and any disputes are subject to the exclusive jurisdiction of the competent courts in Hyderabad.
  3. Indemnification: You agree to indemnify Muzigal from any claims or damages arising from your use of the platform.
  4. Modification: Muzigal reserves the right to modify these terms at any time. Your continued use constitutes your acceptance of these changes.
